§1 General Provisions
  1. The Organizer of the Contest is ZENT sp. z o.o. with its registered office at ul. Sienkiewicza 1, 39-300 Mielec, NIP: 8172214665, REGON: 527891301, registered under number KRS: 0001090270, in the XII Commercial Division of the National Court Register of the capital city of Rzeszów, share capital amount - 5,000 PLN, hereinafter referred to as the "Organizer". 
  2. The Competition is conducted under the rules described in these Regulations in accordance with generally applicable Polish law. 
  3. The Competition starts on 17.12.2024 and ends on 20.12.2024, 13:00 Polish time.
§2. Participants and Competition Rules
  1. Participation in the Competition is voluntary and free of charge.
  2. A natural person (consumer within the meaning of Article 22 of the Civil Code), hereinafter referred to as the Participant, may take part in the Competition who:
    1. has read these Regulations and accepted their content and consented to the processing of personal data for the purpose of conducting the Competition by registering to participate in the Competition; 
    2. has reached 18 years of age and has full legal capacity;
    3. having a delivery address within the territory of the Republic of Poland, 
    4. has a public account (profile) on Instagram, 
    5. will complete the Competition Task. 
  3. Only a person who meets the conditions specified in §2. section 2 of the Regulations may be a Participant in the Competition.
  4. Employees of the Organizer and entities and employees of entities providing services to the Organizer in organizing the Competition under civil law contracts, as well as members of the immediate family (spouses, ascendants, descendants, and siblings) of the aforementioned persons, are excluded from participating in the Competition.
  1. To participate in the Competition during its duration, the Participant will complete the Competition Task. Completing the Competition Task means posting under the competition post published on Instagram at the URL: https://www.instagram.com/p/DDr7rIru1Dz/?utm_source=ig_web_copy_link a comment in response to the question: “How do you take care of oral hygiene during the holidays”?
  2. Only Participants who complete the Competition Task during the Competition period will take part in the Competition. 
  3. The Participant may take part in the Competition only 1 (in words: one) time. 
  4. The Organizer reserves the right to remove and exclude from the Competition completed Competition Tasks whose authors:   
a) do not act on their own behalf but through third parties, 
b) operate from fictitious accounts/profiles on Instagram;
c) create fictitious accounts/profiles on Instagram; 
d) violate the Instagram service regulations.
e) used words in the Competition Task commonly recognized as offensive, pornographic content, content promoting hatred based on race, ethnicity, or religion, or discriminating against social groups, violated the personal rights of persons or third parties or the Organizer.
§ 3 Rights to Completed Competition Tasks
  1. The Participant assures that the completed Competition Task will not infringe any rights or interests of the Organizer, third parties, in particular their proprietary and personal copyrights and personal rights. 
  2. The Participant declares that they hold exclusive and unlimited copyrights to the completed Competition Task and that the completed Competition Task is not encumbered by any third-party rights, and the work has not been previously published. 
  3. Based on Article 921 § 3 of the Civil Code, the Organizer reserves upon awarding the Prize - the acquisition of a non-exclusive license to the Contest Task awarded in the Contest without time and territorial limitations, and the awarded Contest Participant (Winner) grants the Organizer a non-exclusive license to the awarded Contest Task on the following fields of exploitation: 
    1. in the scope of fixing and reproducing the work - producing copies of the work by a specified technique, including printing, reprographic, magnetic recording, and digital techniques;
    2. in the scope of trading the original or copies on which the work has been fixed - placing on the market, lending, or renting the original or copies;
    3. in the scope of disseminating the work in a manner other than specified in point b - public performance, exhibition, display, playback, as well as broadcasting and rebroadcasting, and also public sharing of the work in such a way that anyone can access it at a place and time chosen by them, including introducing the work into computer memory and telecommunications and IT networks.
§4. Prizes and selection of Winners 
  1. To ensure the proper conduct of the Contest, the Organizer will appoint a single-member Committee hereinafter referred to as the Contest Committee. The tasks of the Contest Committee will include overseeing the proper course of the Contest, making decisions on all matters concerning the Contest, including the interpretation of the provisions of these Rules, and selecting Participants who will be awarded Prizes (hereinafter: Winners). The Committee's decisions are final, which does not deprive the Participant of the right to pursue claims arising from legal provisions.
  2. After the Contest ends, the Contest Committee will evaluate the Contest Tasks performed by the Participants and select one winner among the Participants who, in the Committee's opinion, will perform the Contest Task most attractively, originally, and creatively. 
  3. The following prizes will be awarded to the Contest Winners:
Prize: ZENT™ Ultrasonic Cleaner
  1. Prizes are exempt from personal income tax based on Article 21, paragraph 1, point 68 of the PIT Act. 
  2. The Committee will complete the selection of Winners no later than on 20.12.2024
  3. The Contest Winners will be informed about receiving the Prize by posting a list of Winners indicating profile (account) names on the Organizer's profile on Instagram @zentcarepolska in the story and in the description of the contest post, no later than 21.12.2024
  4. Information about winning the Contest will be sent to the Winners in a private message on Instagram.
  5. The condition for receiving the Prize is the delivery by the Winner to the Organizer within 14 days from the day the Organizer sends an e-mail message to the address kontakt@zentcare.pl information necessary for the delivery of the Prize, including in particular: first name, last name, e-mail address, and correspondence address within the territory of the Republic of Poland. 
  6. If the Winner does not provide the data necessary for the delivery of the Prize within the time and under the conditions specified in paragraph 7 above, the Contest Committee will select another Participant to receive the given Prize.
  7. The Organizer is not responsible for failure to deliver the Prize to the Participant if the inability to deliver the Prize resulted solely from the Participant's failure to provide the data required for delivery or providing incorrect or non-compliant data with the Regulations.
  8. Each Prize will be sent once by the Organizer to the address indicated by the Winner within the territory of the Republic of Poland within 7 days from the day the Winner sends all data enabling the shipment of the Prize in response to the notification about the awarded Prize.
  9. The Sponsor of the Prizes is the Organizer. 
  10. The Winner may not transfer the rights to the awarded prize to a third party. 
  11. The Winner has the option to waive the right to the awarded Prize by submitting an appropriate written statement to the Organizer.
  12. The Prize can be received only once in the Contest.
  13. The Prize will be sent to the Participant at the Organizer's expense. 
  14. The Participant does not have the right to demand the exchange of the Prize for a cash prize.
§5. Personal Data
  1. The administrator of Participants' personal data is the Organizer. Contact with the organizer is possible by correspondence at the correspondence address ZENT sp. z o.o., Sienkiewicza 1, 39-300 Mielec and by e-mail address kontakt@zentcare.pl
  2. The basis for processing personal data is Article 6(1)(a) of the GDPR - Participants' consent to participate in the Contest, and Article 6(1)(f) i.e. the legitimate interest of the administrator, especially in terms of handling complaints and pursuing claims.
  3. Participants' personal data will be processed to the extent and for the purpose necessary to conduct the Contest, select Winners, consider any complaints, and in the case of Winners also to notify about the award of the Prize and issue the Prize.
  4. Providing personal data is voluntary, however, it is a condition for issuing Prizes to Winners or submitting complaints, regarding identification and address data. 
  5. Personal data will be stored for the duration of the Contest, and after its completion until the limitation period of any claims or the expiration of the obligation to store data resulting from legal provisions, no longer than 5 years from the end of the calendar year in which the Contest was conducted.
  6. The Organizer exercises the rights of the data subjects, i.e. access to the content of their data and the right to rectify, delete, restrict processing, and the right to data portability.
  7. In the case of processing personal data based on consent, the Participant has the right to withdraw consent at any time, and the withdrawal of consent does not affect the lawfulness of processing carried out based on consent before its withdrawal. Withdrawal of consent requires electronic notification to the e-mail address kontakt@zentcare.pl
  8. Recipients of the data are: entities providing hosting services, postal services, entities cooperating with the Organizer within accounting and tax services, public authorities based on and within the limits of the law, in particular KAS, law enforcement authorities. 
  9. Personal data is not processed automatically and is not subject to profiling. 
§ 6. Complaints
  1. Participants in the Contest have the right to submit a written complaint with the note Holiday oral hygiene with ZENT® to the e-mail kontakt@zentcare.pl or the correspondence address of the Organizer ZENT sp. z o.o., Sienkiewicza 1, 39-300 Mielec related to the course of the Contest during its duration, as well as up to 14 days after the end of the Contest.
  2. The letter containing the complaint should indicate the Participant's first and last name and the correspondence address to which the response to the complaint will be sent.
  3. The Organizer will respond to the Participant's complaint within 14 days by registered mail sent to the address provided in the letter containing the complaint.
  4. A negative consideration of the Participant's complaint by the Organizer does not exclude the Participant's right to pursue claims to which they are entitled under generally applicable legal provisions, including through court proceedings.
§7. Final provisions and technical information.
  1. The Regulations come into force on 17.12.2024
  2. The Contest is not a promotional lottery within the meaning of Art. 2 sec. 1 point 9 of the Act on Games and Mutual Bets of 29.07.1992 (Journal of Laws of 2004, No. 4, item 27, as amended) and is not subject to the rules contained in the aforementioned act and executive regulations to this act.
  3. The Contest Organizer is not responsible for the inability of a potential Participant to submit the completed Contest Task due to reasons solely attributable to the Participant.
  4. The Contest Regulations are made available during the Contest via the public teleinformatics network Internet at the URL address: https://www.instagram.com/p/DDr7rIru1Dz/?utm_source=ig_web_copy_link and at the Organizer's headquarters.
  5. The Organizer undertakes to make every effort to amicably resolve any disputes that may arise in connection with the conduct of the Contest. 
  6. The competent court for resolving disputes is the court with local and substantive jurisdiction in accordance with legal provisions.
  7. This Contest is in no way organized, sponsored, conducted, or endorsed by Instagram or related to it. 
  8. The entity solely responsible for conducting the Contest is the Organizer, and Participants agree to release the Instagram service from any liability that may arise in connection with organizing the Contest.  
  9. Changing the Regulations requires publication and informing Participants about the changes made by the Organizer. Changes may only be made for the purpose of adapting the Regulations to the applicable legal provisions.
